Terms of Use
Welcome to Medibill. By licensing, installing, deploying, or browsing our billing software, management panel, and online storefront platform (the "Services"), you agree to comply with and be bound by the following Terms of Use. Please review these terms carefully.
1. Acceptance of Terms
By using the Services, you confirm that you possess the legal authority to represent your pharmacy or business entity and that you agree to these Terms. If you do not agree to these terms, you are not authorized to use or download our software.
2. Software License
We grant you a limited, non-exclusive, non-transferable, revocable license to utilize Medibill to run your pharmacy operations in accordance with the billing plan you purchase:
- Local Deployments: You are responsible for maintaining the physical hardware, operating systems, and network security required to host the Medibill local runtime.
- No Reselling: You may not modify, reverse-engineer, distribute, or license our code base to third parties for commercial gain without explicit written consent.
3. Pharmacy Compliance and Responsibilities
As a pharmacy operator, you retain full and sole responsibility for compliance with all local laws and rules governing medicine retail in India, including but not limited to:
- Drug Licensing: Maintaining valid state drug licenses for selling Scheduled medicines (Schedule H, H1, X).
- Tax Compliance: Correctly configuring HSN codes, SGST, CGST, and IGST tax splits inside the billing config. Medibill provides tax computation structures, but is not responsible for filing audits.
- Prescription Verification: Reviewing and validating customer prescriptions uploaded or indicated during the online store checkout flow prior to dispensing medicines.
4. Billing, Subscriptions, and Setup
Our pricing model is transparent and consists of a one-time setup fee and subsequent support/update packages:
- One-Time Setup: Covers the technical onboarding and deployment setup of your billing terminal and web store.
- No Commissions: Medibill does not charge transactional fees or commissions on online customer checkouts. You receive all order revenue directly through your chosen settlement routes.
5. Limitation of Liability
Under no circumstances shall Medibill, its developers, or representatives be held liable for any direct, indirect, incidental, or consequential damages resulting from:
- System downtime, database corruptions, local hardware failure, or loss of sales records.
- Incorrect stock updates on your online storefront.
- Errors in manual tax entries or invoice totals generated at your counter.
6. Modifications to Terms
We reserve the right to revise these Terms of Use at any time. When we make updates, the revised date at the top of this page will be updated. Your continued use of the software after updates have been posted constitutes acceptance of those changes.
7. Governing Law
These terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Services shall be subject to the exclusive jurisdiction of the competent courts in India.
